Terms of Service

Please read these terms carefully before using the Code 3 Rescue Live Incident Platform, Mobile App, and AI Assist tools.

EMERGENCY NOTICE: The Code 3 Rescue platform is an incident management tool designed for organizations. It is NOT a replacement for dialing 911. In the event of a life-threatening emergency, always instruct users to contact local emergency services directly.

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("Client", "you", or "your") and Code 3 Rescue Tech, LLC ("Company", "we", "us", or "our"), concerning your access to and use of the c3rescue.com website, the Live Incident Platform v2.0, the Code 3 Rescue iOS and mobile applications, and any related services (collectively, the "Platform").

1. Acceptance of Terms

By accessing, logging in to, or utilizing any part of the Platform, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these Terms, then you are expressly prohibited from using the Platform and you must discontinue use immediately.

2. Description of Services

Code 3 Rescue provides an all-in-one incident management system engineered for modern public safety and event management. The ecosystem includes:

  • Command Center Dashboard: A web-based, zero-installation hub providing live map clustering, sortable incident lists, and PDF/CSV data exports.
  • The Mobile App (Field Team): Custom-branded applications for iOS and Android used by field staff for secure login, team chat, app notifications, and receiving dispatches.
  • Guest Reporting: Web-based QR Code scanning tools allowing bystanders and guests to report incidents without downloading an app.
  • Code 3 Assist: An AI-powered Co-Pilot designed to assist command center operators.

3. Emergency Services & Connectivity Disclaimer

While Code 3 Rescue is built to bridge the gap between incident and intervention, it is a software platform dependent on third-party telecommunications.

  • Connectivity Dependencies: Our mobile apps are optimized for low-bandwidth cellular data (4G/5G/LTE), and our dashboard requires standard internet access. We are not responsible for delayed alerts, missed dispatches, or lack of GPS accuracy resulting from network dead zones, poor Wi-Fi, or carrier outages.
  • Not a Public PSAP: Code 3 Rescue is an internal communication and dispatch tool for your organization. It does not natively connect to local Public Safety Answering Points (PSAPs) unless specifically integrated via an enterprise agreement.

4. HIPAA Compliance and Data Security

We are deeply committed to protecting patient and incident data. Code 3 Rescue adheres to strict privacy standards.

All data traversing the Platform is encrypted in transit via TLS 1.3 and at rest using AES-256 encryption. For medical, EMS, and enterprise clients processing Protected Health Information (PHI), we enter into formal Business Associate Agreements (BAA) prior to deployment to ensure full HIPAA compliance. It is your responsibility to execute a BAA with us before utilizing the platform for PHI.

5. Use of Code 3 Assist (AI Co-Pilot)

The "Code 3 Assist" feature is an AI-driven tool designed to reduce cognitive load by providing instant protocol access, drafting structured incident narratives, and serving as an interactive knowledge base.

Limitations of AI: Code 3 Assist is a support tool, not a human decision-maker. It does not replace the professional judgment of medical providers, tactical commanders, or safety directors. You agree to independently verify any checklists, protocols, or narrative reports generated by Code 3 Assist before executing actions or submitting official legal records.

6. User Accounts, Security, and Setup

For standard events, deployment can occur in under 24 hours. Enterprise setups with custom map overlays may take 3-5 business days. Once deployed:

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must ensure that all staff utilizing the platform have received adequate training.
  • You are responsible for all activities that occur under your organizational account.

7. Intellectual Property

Code 3 Rescue retains all ownership rights, title, and interest in and to the Platform, including but not limited to all software code, visual interfaces, graphics, AI models, and custom-branded apps (excluding your logos and trademarks). You retain all ownership rights to the incident data, logs, and reports generated by your organization.

8. Limitation of Liability

IN NO EVENT WILL CODE 3 RESCUE TECH, LLC, ITS FOUNDERS, DIRECTORS, OR EMPLOYEES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR INJURY/DEATH ARISING FROM YOUR USE OF THE PLATFORM.

While our platform targets 24/7 uptime reliability, we do not warrant that the platform will be uninterrupted or error-free. The platform is provided on an "AS-IS" and "AS-AVAILABLE" basis.
